Consumer Alternative Dispute Resolution

Traditionally, legal disputes have been resolved in courtroom proceedings.  Over the last several years, various forms of alternative dispute resolution have become popular with lawyers and their clients.

There are many types of alternative dispute resolution including both arbitration and mediation proceedings.

 

Mediation

Mediation is a negotiation among the individuals or entities involved in a dispute, assisted by an impartial third party, known as a mediator. The purpose of a mediation is to resolve the matter by developing a mutually acceptable outcome for the parties.  Success in a mediation is dependent on the parties reaching an agreement.

 

Arbitration

In an arbitration, the parties submit the facts and issues of a matter to an appointed neutral third party, known as an arbitrator, who acts as a private judge between the parties and issues a decision. Arbitration, unlike mediation, is legally binding for all of the parties involved and the arbitrator’s award is final, and enforceable in the courts. Simply put, arbitration is a substitute for a trial with a judge who is mutually appointed by the parties.

Alternative dispute resolution may:
• be much less expensive than traditional methods such as going to court;
• be a much faster way to resolve a matter; and
• be agreed by the parties to be a private matter rather than a public one in a state or federal court.

Buzz Tarlow has been involved in the field of alternative dispute resolution for more than two decades as counsel to parties in mediations and arbitrations, and as both a mediator and an arbitrator in cases involving construction disputes, as well as business, real estate, employment, and personal injury cases.

Buzz is a member of the National Construction Panel of Arbitrators for the American Arbitration Association and is a part of the AAA National Roster of Mediators.  In addition to completing training and maintaining continuing education requirements, he has also been an active speaker and author on dispute resolution topics.

He regularly acts as a mediator and arbitrator in construction disputes, as well as other types of disputes,and is a member of the National Construction Panel of Arbitrators for the American Arbitration Association, the National Academy of Distinguished Neutrals, and the Chartered Institute of Arbitrators.
