Margaret C. Weamer

Margaret C. Weamer has a broad civil and commercial litigation practice emphasizing employment, construction, and real property.

In her employment practice, Ms. Weamer works with local, national, and international companies in virtually all aspects of the employment relationship, including negotiating contracts, drafting employment handbooks, and handling complex disputes in administrative and court proceedings including class action representation.  She has also represented employees in reviewing and negotiating employment agreements and has brought claims in administrative and court proceedings for discrimination, wage claims, and wrongful termination.

In her construction practice, Ms. Weamer has represented materials suppliers, contractors, subcontractors, design professionals, and owners in many aspects of the construction industry, from the initial contracting phase to litigating complex disputes.  Her work often entails pursing insurance coverage under several types of policies that are generally involved in construction cases, as well as representing policy holders in coverage disputes.

In her real property practice, Ms. Weamer has represented commercial and residential property owners in navigating local land use regulations and has represented owners before local land use boards and planning and zoning commissions.  She has worked with businesses and individuals in a variety of transactions including purchase and sale agreements and lease negotiations. In addition, Ms. Weamer handles real property and easement disputes of all types.

Ms. Weamer has previously served as the president of the local Gallatin County Bar Association and is the 2020 president of the Montana Justice Foundation.  She is also an American Bar Association Fellow, a member of the American Bar Association, and a member of the American Bar Association’s Forum on the Construction Industry.

Ms. Weamer joined the firm in 2007, after serving as a law clerk for the Hon. Justices Morris, Cotter and Warner of the Montana Supreme Court.  She has been a partner in the firm since 2013.

Ms. Weamer received her J.D. from the University of Montana in 2006 where she was a member of the National Moot Court Team and a legal research and writing teaching assistant.

Although she believes “free time” is a misnomer, when she’s not zealously representing her clients, she enjoys weightlifting, mountain biking, skiing, and just about everything else Montana’s great outdoors has to offer.
